Q: How long can I continue to receive total disability benefits?

A:

If you are unable to return to your time of injury job, until such time that you return to work or the employer can prove that you are capable of returning to work, then you will continue to receive workers' compensation benefits.  There are certain lifetime restrictions after you have been receiving compensation for two years that essentially limit you to an additional 500 weeks of compensation.  If the employer can prove that you are capable of returning to modified employment, you are limited to an additional 500 weeks of partial disability benefits.
