Employer Entitled to Vocational Expert Exam

To assess earing power of employee, employers are entitled to vocational expert examination of the injured worker

The Act 57 Amendments provide that an employee may require an employee to submit to an interview with a vocational expert. Similar to the requirement of medical examinations, the employee’s refusal to submit to such an examination ordered by a Workers’ Compensation Judge may result in the suspension of benefits during the period of refusal.
