Court in Pennsylvania holds that an employer who reimburses a DPW/Medicaid lien cannot be held responsible for amount medical providers would be entitled to under WC Act

in many cases, the right to workers compensation is contested by the employer. Hence, claim petitions are filed. But in the meantime, claimants who have immediate needs for medical treatment, other payers such as group health insurance, Medicare, or Medicaid, step in and pay the healthcare provider billings.

However, in cases where the provider accepted Medicaid payments, where the claim is resolved and DPW or Medicaid is reimbursed the full amount, the healthcare provider is precluded from seeking any additional reimbursement allegedly due under the Workers' Compensation Act reimbursement schedules.
