Crime Victims Must Show Landowner’s Negligence in Failing to Provide Security Caused Injuries

Crime Victims who have been seriously injured in an attack on or near the premises of a landowner must provde that the landowner’s negligence in failing to provide adequate security was the proximate cause of the plaintiff’s injuries. The crime victim must also show that “but for” the landowner’s actions or failure to act, that the crime would not have occurred and that the landowner’s acts or omissions were a substantial factor in causing the injuries to the crime victim. Crime victims must show that the extra security that was lacking would have made a difference.
