Resumption of Workers’ Compensation After Modification or Suspension

In specific circumstances where there has been certain changes, your weekly workers’ compensation wage benefits can be reinstated

  1. The Workers’ Compensation Act provides for the resumption of benefits under the following circumstances when compensation benefits have been modified, suspended, or commuted in the past:Recurrence of disability or loss of earning power after return to pre-injury job with no restrictions
  2. Recurrence of disability or loss of earning power after return to pre-injury job with restrictions
  3. Recurrence of disability or loss of earning power after return to modified job
  4. Recurrence of disability or loss of earning power after discharge from modified job
  5. Recurrence of disability or loss of earning power after voluntary withdrawal from modified job
  6. Increase in disability or loss of earning power after modification/suspension for bad faith conduct
  7. Recurrence of total disability after commutation
  8. Recurrence of disability or loss of earning power after filing a notification of modification/suspension
  9. Reinstatement after failure to attend an Independent Medical Exam
  10. Reinstatement after refusal of reasonable and necessary medical treatment
  11. Reinstatement after failure to submit an LIBC Form 760
  12. Reinstatement after IRE of less than 50 percent
  13. Reinstatement after refusal to attend a vocational expert interview
  14. Reinstatement after incarceration.
