In specific circumstances where there has been certain changes, your weekly workers’ compensation wage benefits can be reinstated
- The Workers’ Compensation Act provides for the resumption of benefits under the following circumstances when compensation benefits have been modified, suspended, or commuted in the past:Recurrence of disability or loss of earning power after return to pre-injury job with no restrictions
- Recurrence of disability or loss of earning power after return to pre-injury job with restrictions
- Recurrence of disability or loss of earning power after return to modified job
- Recurrence of disability or loss of earning power after discharge from modified job
- Recurrence of disability or loss of earning power after voluntary withdrawal from modified job
- Increase in disability or loss of earning power after modification/suspension for bad faith conduct
- Recurrence of total disability after commutation
- Recurrence of disability or loss of earning power after filing a notification of modification/suspension
- Reinstatement after failure to attend an Independent Medical Exam
- Reinstatement after refusal of reasonable and necessary medical treatment
- Reinstatement after failure to submit an LIBC Form 760
- Reinstatement after IRE of less than 50 percent
- Reinstatement after refusal to attend a vocational expert interview
- Reinstatement after incarceration.
