Workers’ Compensation Act specially defines what injuries are excluded

  1. The Pennsylvania Workers’ Compensation Act specifically excludes the payment of workers’ compensation benefits in six distinct circumstances:Intentional self inflicted injury or death is not compensation.
  2. Employee’s Violation of law such as the illegal use of drugs.
  3. When the injury is caused by the violation of a positive order which the employee knew of before the date of injury, and the order prohibited an activity not connected with the employee’s work duties.
  4. An injury caused by the act of a third person intending to injure an employee because of reasons personal to the third person and not directed against the employee because of the employment.
  5. Injuries that would not have occurred but for the intoxication of the employee.
  6. Injuries which occur during hostile attacks on the United States.
