Pennsylvania Law requires you to report your work injury within 120 days
The Pennsylvania Workers’ Compensation Act specifically requires injured workers to report their injury within 120 days. Under certain circumstances, the time for giving notice of an injury does not begin to run until the employee knows, or by the exercise of reasonable diligence should know, of the existence of the injury and its possible relationship to the employment.
In matters of continuing trauma, the last exposure or trauma date is the one that controls.
The employee has the burden of proving the employer’s receipt of notice and the employee’s mere statement that a letter was mailed to the employer has been found to insufficient.
