Indemnity Payments are paid depending length of disability
Commencement of Indemnity (wage loss) Benefits under the Pennsylvania Workers’ Compensation Act:
No compensation is paid during the first 7 days after disability begins.
If disability lasts 14 days or more, compensation is paid from the first date of injury resulting in wage loss.
If disability is greater than 7 days, but less than 14 days, those days of lost wages are paid.
The first installment of compensation (wage loss) shall be paid no later than the 21st day after the employer has notice or knowledge of the employee’s disability.
However, in those cases where notice is not provided immediately, the right to compensation exists only from the date of notice of the injury.
Interest is payable at the rate of 10% per years on all past due and unpaid installments.
Compensation is to be paid in the same periodic installments as an employee’s wages were paid before the injury. However, as a practical matter most insurance companies pay on a bi-weekly basis unless ordered to do otherwise.
All subsequent payments must be prompt and unconditional except in circumstances where the employee fails to complete the required reporting forms.
